These Terms of Use govern your relationship with MAGMA Learning LLC, located at Avenue Druey 13, 1018 Lausanne, Switzerland. By using the MAGMA Mentor app on mobile or computer (collectively, the "Service"), you agree to these Terms of Use and our Privacy Policy, which outlines how we handle personal information.
Service Description
The MAGMA Mentor app is a personal AI tutor designed to enhance your learning.
Content generation: The MAGMA Mentor app generates microlearning content based on your input, using the GPT API provided by OpenAI LLC (San Francisco). Please verify the accuracy of output content as it may not always reflect real facts due to the probabilistic nature of machine learning.
Personalized learning: The app implements learning science recommendations, like personalization, spaced reactivation, and retrieval practice, to help you achieve your learning goals effectively.
Knowledge visualization: The app organizes key concepts from your learning contents in a three-dimensional network ("learnet"), reflecting your knowledge level for each concept.
User Accounts
You must create an account to access the Services. The only data required is a valid email address and any secure password.
You are responsible for maintaining the confidentiality of your account credentials. Please do not share your account information with others. If you suspect unauthorized access to your account or any other security breaches, please notify us immediately.
We reserve the right to suspend or terminate your account in case of violations of the terms and conditions or for other reasons deemed appropriate.
We may collect and process user data as outlined in the Privacy Policy. Please review the Privacy Policy to understand the data processing practices.
Payment
Free Tier: The MAGMA Mentor app offers a free tier with limited features and quality of contents. The availability of features and contents in the free tier is subject to change at our discretion.
Premium Tier: The MAGMA Mentor app offers premium tiers with additional features and higher-quality content. If you opt for the premium tiers, you agree to pay the specified service fees associated with the chosen premium tier. These fees may vary based on the selected tier and the subscription plan.
Payment Authorization for Premium Tiers: By subscribing to a premium tier, you authorize us to charge your selected payment method for the applicable service fees. Ensure that the payment information provided is accurate and up-to-date.
Subscription Renewal for Premium Tiers: If you choose a premium tier with a recurring subscription, it will automatically renew at the end of each billing cycle unless you cancel your subscription before the renewal date.
Payment Security: We take appropriate measures to ensure the security of payment transactions. However, we do not assume liability for any unauthorized access or breaches of payment information beyond our control.
Failed Payment: In the event of a failed payment for a premium tier subscription, we may suspend or terminate access to premium features until the outstanding payment is resolved.
Refund Policy
Refunds for premium tier subscriptions may be available under certain circumstances. You can request a refund within 7 days from the date of your initial premium tier subscription purchase. Refunds are provided for technical issues or valid reasons preventing effective use of premium features. Refunds do not include subscription fees already utilized during the active subscription period. To initiate a refund request, contact our support team at contact@magmalearning.com. Explain the reason for the request and provide relevant details or evidence. If approved, refunds will be processed using the original payment method for the subscription purchase. This refund policy is subject to change at our discretion. Updated policies will be effective from the date of the changes.
Liabilities and Disclaimers
Accuracy of Content: While we strive to provide accurate and up-to-date information through the MAGMA Mentor app, we do not guarantee the completeness, reliability, or accuracy of the content. Users acknowledge that any reliance on the app's content is at their own risk.
Educational Purposes Only: The content and information provided by the MAGMA Mentor app are intended for educational purposes. It should not be considered as professional advice or a substitute for personalized guidance from qualified professionals.
Third-Party Content and Links: The app may contain links to third-party websites or services. We are not responsible for the content, policies, or practices of such external sites, and users access them at their own discretion.
Technical Issues: While we take measures to ensure the app's stability and security, we cannot guarantee uninterrupted access or freedom from technical glitches. Users acknowledge that occasional downtime or issues may occur.
Limitation of Liability: In no event shall MAGMA or its affiliates be liable for any direct, indirect, incidental, consequential, or punitive damages arising from the use or inability to use the app or its content.
Indemnification: Users agree to indemnify and hold MAGMA, its team, and affiliates harmless from any claims, liabilities, or expenses arising from user actions, violations, or misuse of the app.
Third-Party Services: Any interactions with third-party services or content accessed through the app are subject to the respective terms and conditions of those services. We do not assume responsibility for such third-party offerings.
Content Modifications: MAGMA reserves the right to modify or remove any content within the app without prior notice. We may update the app's features, functionalities, and content at our discretion.
No Warranties: The MAGMA Mentor app is provided on an "as is" and "as available" basis, without any warranties or guarantees, including fitness for a particular purpose.
Updates and Modifications
We may make changes to this Agreement and to the Service from time to time. The most recent version applies.
Governing Law
The MAGMA Mentor app and its terms of use are governed by the laws of Switzerland, with the exclusive jurisdiction of the courts in the Canton of Vaud for any disputes or legal matters.
